TS 14+ makes a generative artificial intelligence assistant (referred to as "Shopper Assistant" and "Grace") available on the Taking Shape website to help customers with product search, styling guidance, sizing information, and general queries.

By accessing or using Grace, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Shopper Assistant.

Intended use

We grant you a voluntary limited, non-exclusive, non-transferable and revocable licence to use Grace based on the Intended Use.

• Available to all users of Takingshape.com/NZ, whether you are signed in to My Account or browsing as a guest.
• Information is of a general and suggestive nature only; you must check the validity of the information before making any decision or purchase.
• Answers may be inaccurate and do not represent the views shared by TS 14+
• Do not share any personal information such as, but not limited to, phone number, date of birth, address or payment details.
• You are responsible for all content, queries and other material you submit to Grace.
• You warrant that your inputs do not breach any applicable laws, regulations or these Terms of Use.
• We reserve the right to withdraw Grace at any time.

You must not:

• Copy, modify, decompile, reverse engineer or otherwise attempt to derive the source code of, or any algorithm used by, the Shopper Assistant.
• Introduce or share any virus, worm, defect, Trojan horse or other malicious code to the Shopper Assistant.
• Use Grace to generate, transmit or request any content that is unlawful, defamatory, discriminatory, harassing, threatening or obscene in any way.
• Manipulate, circumvent or exploit Grace and its safeguards.

Collection and use of information

We may collect and store information that you submit, including any queries or answers that you provide to Grace.

Information will be handled in accordance with our Privacy Policy.

You should not submit sensitive personal information, confidential information, or personal information relating to a third party without that person's consent.

The Shopper Assistant may be powered, in whole or in part, by a third-party technology provider. Where applicable, your Input may be processed by that third-party provider for the purpose of generating a response or to train it for future use.

Information collected through the Shopper Assistant is used to respond to your queries, operate and improve the Shopper Assistant, and for technical support purposes.

We will retain this information only for as long as reasonably necessary for these purposes, or as otherwise required by law.

Styling, sizing and product information

The Shopper Assistant may generate styling suggestions, sizing guidance or product recommendations based on the Input you provide. Such output is generated by AI and is provided for general guidance only; it does not constitute advice and may not accurately reflect details such as but not limited to fit, fabric, colour or features of any product.

Refer to the applicable product description, size guide, and images on our website before making a purchasing decision, and do not rely solely on the Shopper Assistant's output. Consider your personal circumstances and consult professional advice where necessary.

Pricing and availability

Any pricing or stock availability information provided by the Shopper Assistant is indicative only and does not constitute an offer or quotation capable of acceptance. The price and availability displayed at checkout on our website, or confirmed in-store, will determine the final price.

Feedback and intellectual property

Where you provide feedback, comments or suggestions in relation to the Shopper Assistant (Feedback), you agree that we may use, reproduce and modify that Feedback, including to develop and improve the Shopper Assistant, without any obligation or payment to you. To the extent any intellectual property rights arise in your Feedback, you assign those rights to us.

The Shopper Assistant is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no representation or warranty, express or implied, as to the accuracy, completeness, reliability, currency or fitness for purpose of the Shopper Assistant or any output it generates.

The Shopper Assistant is an evolving tool and may, on occasion, generate output that is inaccurate, incomplete or inconsistent with our products or values. You should not rely on the Shopper Assistant as a substitute for the applicable product information on our website, our customer service team, or professional advice, and any reliance on its output is at your own risk.

Where the Shopper Assistant's output includes a link to a third-party website, that link is provided for convenience only. We do not endorse, and are not responsible for, the content of any linked third-party website.

Nothing in this clause limits or excludes any guarantee, right or remedy conferred on you under the Australian Consumer Law, the New Zealand Consumer Guarantees Act, or any other applicable law that cannot lawfully be excluded, restricted or modified.

Suspension and termination

We may, at our discretion and at any time, suspend, restrict or terminate your access to the Shopper Assistant, including where we reasonably consider you have breached this clause, without liability to you.

If we suspend or terminate your access, the licence granted to you immediately ceases. Any provision of this clause which by its nature should survive termination will continue to apply.

Changes and contact

1. These T&Cs contain the terms and conditions on which Taking Shape will provide the Rewards Extra Program to Members
2. These T&Cs apply to a Member's participation in all Promotional Activity, redeeming Rewards Vouchers and loyalty transactions
3. By joining the Rewards Program, Members agree to be bound by these T&Cs
4. Taking Shape may make offers within the Rewards Program that are subject to additional conditions and those conditions will form part of these T&Cs and will prevail to the extent of any inconsistency
5. Current T&Cs are available on the Website
6. Subject to the Australian Consumer Law, Taking Shape may cancel, terminate, modify or suspend the Rewards Program, or vary the T&Cs at any time in its absolute discretion
7. Decisions made by Taking Shape in relation to the Rewards Program are final

2. Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth)
3. Australian Stores includes all Australian Taking Shape Boutiques, Taking Shape Myer Concept Stores, Taking Shape Clearance Stores and TakingShape.com/AU. Australian Stores does not include purchases made on Myer.com or any other Online Marketplaces.
4. Birthday Voucher means a Rewards Voucher issued on or around a Member's birthday
5. In Store means a transaction taking place in any Taking Shape Boutique, Taking Shape Myer Concept Store, Taking Shape Clearance Store or Online at TakingShape.com
6. Inappropriate Conduct includes (but is not limited to) conduct by a Member in relation to the Rewards Program that involves fraud, offensive or abusive conduct, inappropriate or unauthorised use of or access to information belonging to Taking Shape or another Member, failure to pay any monies owing, and/or a breach of these T&Cs
7. Member means an individual residing in Australia or New Zealand whose application for Membership of the Rewards Program is accepted by Taking Shape, and whose Membership remains current
8. Member Profile means the information linked to a Member's personal Rewards Program membership account, including communication preferences
9. NZD means New Zealand Dollar(s)
10. New Zealand Stores includes all New Zealand Taking Shape Boutiques, Taking Shape Clearance Stores and TakingShape.com/NZ
11. Point means a point earned by a Member via participation in the Rewards Program
12. Program Year means the period from 1 July to the following 30 June
13. Promotional Activity includes: Any special offers, temporary price reductions or events that are undertaken In Store and/or Online.
14. Reward Tiers means the membership level of a Member (Asset, Silver, Gold, Platinum or Diamond) as determined by the Member's Point Balance
15. Rewards Voucher means a fixed value voucher able to be redeemed by a Member
16. Rewards Program means the Taking Shape Rewards Extra Program
17. T&Cs means these terms and conditions as updated or added to by Taking Shape
18. Technical Issues means the technical malfunction of any telephone or telecommunications network, connection or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website or intranet site (including the Website)
19. Taking Shape means TS14 Plus Australia Pty Ltd ABN 69 032 764 154 or its authorised representatives
20. Website means the website at www.takingshape.com

1. You may apply to be a Member by signing up In Store (which may be at a store location or online at www.TakingShape.com)
2. Membership is only open to individuals who provide their name, valid email address and contact phone number and reside in Australia or New Zealand
3. If you become a Member, you will be issued with one Member Profile which is personal to the Member. Members are not permitted to apply for or use any other Member Profile. Members must not allow another person to use their Member Profile.
4. Taking Shape may terminate or suspend a Member Profile at any time if Taking Shape reasonably believes that a Member has engaged in Inappropriate Conduct
5. Membership is personal to the Member and is not transferable
6. Taking Shape employees cannot become Members whilst Taking Shape employs them
7. Members may any time terminate their membership by providing written notice to Taking Shape Customer Service Team by completing this Contact form

1. Members are entitled to earn Points after they become a Member
2. Members can earn Points in their Member Profile when they purchase Taking Shape full priced, sale or clearance products or full priced, sale or clearance products on temporary promotion In Store (including online). Points cannot be earned on the purchase of Gift Cards.
3. To earn points for online purchases made at www.TakingShape.com, a Member must be signed in to their online shopping account to make the purchase and enter all the required Member information
4. Points will not be issued for gift card purchases. Points will be issued when a Member redeems gift cards In Store
5. Points will not be issued on the redemption of Rewards Vouchers, Birthday Vouchers or Anniversary Vouchers
6. 1 Point will be issued for each $1AUD or $1NZD that a Member spends on full priced, sale or clearance products or full priced, sale or clearance products on temporary promotion
7. Taking Shape reserves the right to vary the method of allocation of Points at any time and without notice.
8. Each Member's Points balance will be reset to zero at the beginning of each Program Year
9. Points cannot be awarded for purchases made by a Member before joining the Rewards Program
10. Points earned may not appear in a Member Profile for up to 48 hours from the transaction time
11. Members must check their Member Profile regularly to confirm that points are being credited properly
12. Members must notify Taking Shape of any discrepancies in their Member Profile within three months from the relevant transaction. Taking Shape reserves the right to decline to make any amendments for discrepancies outside that period
13. Points do not constitute any form of property or currency
14. Points earned on the purchase of products that are subsequently returned for a full refund, will be deducted from the Member's Point balance

1. There are five Tier Levels within the Rewards Program - Asset, Silver, Gold, Platinum and Diamond.
2. Taking Shape will allocate Members to a Reward Tier according to their current Points balance.
3. Taking Shape reserves the right to change the Reward Tier names, points balance allocations and benefits at its discretion and without notice.
4. At the beginning of each Program Year, members will be allocated to the Reward Tier that corresponds with the number of Points the Member earned in the previous Program Year (e.g. a Member in Gold tier will remain at Gold tier provided the Member has earned 750 to 1249 Points in the previous Program Year but if the Member has earned 250 to 749 Points, the Member will revert to Silver tier).
5. Taking Shape may upgrade or maintain a Member's Reward Tier at its absolute discretion.

1. Subject to the Member's entitlements, Taking Shape will issue Rewards Vouchers to a Member in the first full week of each month based on the Reward Tier reached at the end of the previous month (e.g. Rewards Vouchers issued in the first week of April will be based on a Membership Points Balance on 31st March). Rewards vouchers are communicated via email and/or SMS to the email address/phone number provided upon joining the Rewards Program (depending on the Member's communication preferences).
2. Rewards Vouchers cannot be sold, transferred or assigned to another party and are not redeemable for cash – including (but not limited to) gift vouchers, gift cards, cheques or credit cards.
3. Rewards Vouchers cannot be used to make an instalment payment on a BNPL plan or in conjunction with PayPal.
4. Rewards Vouchers will be issued in the currency of the country registered on the Member's Profile.
5. Members will not earn Points on the redemption of Rewards Vouchers.
6. Rewards Vouchers can only be redeemed for the purchase of full priced products.
7. Rewards Vouchers cannot be redeemed to purchase full priced styles on temporary promotion, clearance, reduced or sale items.
8. Rewards Vouchers issued in AUD can only be redeemed in Australian Stores or on www.TakingShape.com/AU/ and cannot be redeemed on Myer.com and in any New Zealand Stores.
9. Rewards Vouchers issued in NZD can only be redeemed in New Zealand Taking Shape Stores or on www.TakingShape.com/NZ/ and cannot be redeemed in any Australian Stores.
10. Taking Shape may in its absolute discretion exclude certain items and promotions from being redeemed using Rewards Vouchers.
11. A Taking Shape Team Member will process Rewards Vouchers redeemed in Taking Shape Myer Concept Stores. Myer Team Members are unable to process Rewards Vouchers.
12. All Rewards Vouchers have a clearly marked expiry date.  Taking Shape will notify Members of the expiry date of each Rewards Voucher. 
13. A Rewards Voucher may not be redeemed after the expiry date. Taking Shape reserves the right to extend the expiry date of any Rewards Voucher at any time without reason.
14. Upon termination of a Membership, all Rewards Vouchers held by the Member will be void and unable to be redeemed.
15. Taking Shape will not be held responsible or liable if a Rewards Voucher is not redeemable in the case of a Technical Issue but in that case, Taking Shape will use reasonable endeavours to rectify the error to ensure that the Rewards Voucher can be redeemed.
16. Rewards can only be redeemed once. Rewards Vouchers used multiple times will be declined and the Taking Shape Customer Service Team will contact the Member to arrange an alternative payment or otherwise amend the Member's Points balance accordingly.
17. Reward Vouchers must be redeemed in a single transaction. Change or credit notes will not be issued for any value unspent.
18. Where items purchased with a Rewards Voucher are refunded in a Taking Shape Boutique or Clearance Store the value of the Rewards Voucher will be returned as a credit note (unless otherwise required by law).
19. Where items purchased with a Rewards Voucher are refunded at www.TakingShape.com the value of the Rewards Voucher will be returned to the original Taking Shape Rewards Voucher.
20. Where items purchased with a Rewards Voucher in a Taking Shape Myer Concept Store are refunded, the value of the Rewards Voucher will be forfeited (unless otherwise required by law)
21. A maximum of one Rewards Voucher per Reward Tier, per Member, per Program Year will be issued.
22. A Rewards Voucher is not legal tender in any country.
23. Taking Shape is not responsible for any lost or stolen Rewards Vouchers and is not liable to replace any Rewards Voucher that is lost or stolen.

Birthday Vouchers will be issued to an eligible Member, where possible in the first full week of Member’s Birthday month based on the Reward Tier reached at the end of the previous month (e.g. for a Member’s Birthday in September the Birthday Voucher will be issued in the first week of September and it will be based on the Member’s Reward Tier on 31st August). Birthday vouchers are communicated via email and/or SMS to the email address/phone number provided upon joining the Rewards Program (depending on the Member’s communication preferences).
2. To receive a Birthday Voucher, a Member must provide their birthday information at least one month prior to their birthday and be a Silver tier or higher.
3. Except as otherwise set out in this 'Birthday Vouchers' section, the terms and conditions for Rewards Vouchers apply to Birthday Vouchers.
4. Birthday Vouchers are not retrospective and will not be issued for Birthdays that occurred prior to becoming a Member, or prior to completing and providing the required information.
5. Birthday Voucher values are determined by the Member's Reward Tier at the time of issuance (not at the time of their birthday).
6. Birthday Surprise will be sent to eligible Diamond tier customers via email on the day of their birthday. Birthday Surprise Gift will be valid for 120 days after the email is sent.

1. The Anniversary Reward is a loyalty benefit that celebrates the anniversary of the date a customer joined the Taking Shape Rewards program
2. Anniversary Vouchers will be issued to an eligible Member, where possible in the first full week of Member’s Anniversary month based on the Reward Tier reached at the end of the previous month (e.g. for a Member’s Anniversary in September the Anniversary Voucher will be issued in the first week of September and it will be based on the Member’s Reward Tier on 31st August). Anniversary vouchers are communicated via email and/or SMS to the email address/phone number provided upon joining the Rewards Program (depending on the Member’s communication preferences).
3. To receive an Anniversary Voucher, a Member must be a Silver tier or higher.
4. Except as otherwise set out in this 'Anniversary Vouchers' section, the terms and conditions for Rewards Vouchers apply to Anniversary Vouchers.
5. Anniversary Vouchers are not retrospective and will not be issued for an Anniversary that occurred prior to becoming a Member, or prior to completing and providing the required information.
6. Anniversary Voucher values are determined by the Member’s Reward Tier at the time of issuance (not at the time of their Anniversary).

1. Member's personal information will be collected, used and stored for the purpose of conducting the Rewards Program or as otherwise stated at the point of collection or in the Taking Shape Privacy Policy.
2. Members must ensure that their information is accurate and current.  Members must update their Membership Profile when their contact details change including but not limited to email address, phone number and mailing address. This can be done by signing into the Member Account at www.TakingShape.com
3. Taking Shape will provide Members with their personal information on request, subject to reasonable verification requirements.
4. Taking Shape may (but is not obliged to) provide Members with statements relating to their membership activity from time to time. 

1. Where Taking Shape must give a Member notice of any matter concerning their Membership, Members agree that Taking Shape will be taken to have given the Member notice if Taking Shape sends the Member a communication (whether by email, post or otherwise) to the email or mailing address recorded in the relevant Member Profile.
2. Members agree that email will satisfy any requirement for written communication. The Member will receive any electronic communication sent by Taking Shape on the next business day after Taking Shape sent it.
3. Taking Shape will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Rewards Program or may cause any email communication to any Member to be misdirected, lost or not received

1. Taking Shape does its best to provide current and accurate information but the currency of information may change from time to time and Taking Shape may need to correct statements and representations made about the Rewards Program or a Member Profile.
2. To the maximum extent permitted by law, all conditions, rights, remedies, liabilities and other terms implied by law are excluded from these T&Cs and Taking Shape is not responsible to Members or anyone else for any loss arising out of the use of the Rewards Program. 
3. Subject to the Australian Consumer Law, the Rewards Program is provided on an "as is" basis without warranties of any kind, either express or implied and Taking Shape makes no warranties or representations as to the operation of the Rewards Program.  To the extent liability cannot be excluded, any liability incurred by Taking Shape in relation to a Member's use of the Rewards Program is limited to the maximum extent provided for by the Australian Consumer Law. Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law.
4. Taking Shape will not be liable for any tax liability incurred by a Member in connection with the Rewards Program, including that incurred in the provision of Rewards Vouchers.
